By accessing or using Workinger ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of Workinger, including beta testers, and constitute a legally binding agreement between you and Appinger.

2. Beta Software Disclaimer

Important: Workinger is currently in beta testing phase. By participating in the beta program, you acknowledge and agree that:

• The software is provided "as is" and may contain bugs, errors, or incomplete features
• Service interruptions, data loss, or unexpected behavior may occur
• Features may change, be removed, or function differently without notice
• We are not liable for any damages arising from the use of beta software
• Your feedback and usage data may be used to improve the Service

3. Eligible Use

You must be at least 13 years old to use Workinger. If you are between 13 and 18, you must have parental consent to use the Service.

Workinger is designed as a productivity and focus enhancement tool. You agree to use the Service responsibly and in accordance with these Terms.

4. Account Registration

To access certain features of Workinger, you may need to create an account. You agree to:

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

5. Acceptable Use Policy

6. Exercise and Physical Activity Disclaimer

Important Health Notice: Workinger includes exercise-based accountability features (such as burpees). By using these features, you acknowledge that:

• You are physically capable of performing the required exercises
• You will exercise at your own pace and within your physical limitations
• You assume all risks associated with physical exercise
• We are not responsible for any injuries that may occur during exercise
• You should consult a healthcare provider before starting any exercise program
• You can modify or skip exercises if needed for health reasons

7. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Workinger, you consent to the collection and use of your information as described in our Privacy Policy.

8. Intellectual Property Rights

Workinger and all related content, features, and functionality are owned by Appinger and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use Workinger for personal, non-commercial purposes, subject to these Terms.

9. Service Availability

We strive to provide reliable service, but we do not guarantee that Workinger will be available 100% of the time. Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical difficulties or server issues
• Force majeure events beyond our control
• Beta testing limitations

10. Termination

We may terminate or suspend your access to Workinger at any time, with or without notice, for any reason, including violation of these Terms.

You may terminate your account at any time by contacting us at support@workinger.app.

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

11. Limitation of Liability

To the maximum extent permitted by law, Appinger shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of Workinger.

Our total liability to you for all claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Appinger, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Workinger or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of Workinger after changes to the Terms constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
